Terms and Conditions

Last updated October 18, 2026

These terms are the agreement between you and BrightSpheres LLC, an Arizona limited liability company doing business as InstaTalent ("InstaTalent", "we", "us"), for using InstaTalent. Please read them with our Privacy Policy. Employers using AI interviews also agree to our Data Processing Agreement.

1. Accepting these terms

By creating an account, joining the Talent Network, posting a job, applying, requesting an introduction or taking an interview, you agree to these terms. If you use InstaTalent for a company, you confirm you are allowed to accept them for that company, and "you" includes the company.

2. What InstaTalent is

  • The InstaTalent Talent Network: web developers and designers join, take a structured AI interview, and are reviewed by our team before their profile is listed in the directory. Approved companies browse these profiles and request introductions; a candidate accepts or declines each request, and contact details are shared only when they accept.
  • A free job board: employers post jobs, job seekers create profiles and apply, and both can message each other.
  • AI interviews: employers can invite candidates to a voice interview conducted by an AI interviewer. The interview is recorded and transcribed, and an AI drafts a report that scores the answers against the employer's rubric, with quotes from the interview as evidence.
  • Plans for employers that include a monthly number of introductions and AI interviews, with optional extras.

3. Accounts

You must be at least 16 and of legal working age where you live. You agree to:

  • Give accurate information and keep it up to date
  • Keep your login secure, and tell us promptly about any unauthorised use
  • Take responsibility for activity under your account and, for employers, your team members

4. AI assistance: what the scores are, and what they are not

AI interview reports are evidence to help a person decide, not decisions. The AI can misunderstand speech, miss context or be wrong. Every score links to what the candidate actually said so a reviewer can check it.

  • A human at the employer must review the evidence and make every hiring decision. Do not reject a candidate based only on an AI score.
  • InstaTalent does not decide who is hired and does not guarantee the accuracy, completeness or fitness of any AI output.
  • The AI assesses the content of answers (and, for English assessments, spoken language). It does not analyse faces, emotions or appearance.

5. Employer responsibilities

For candidate data in your hiring, you are the data controller and we are your processor. You are responsible for:

  • Having a lawful basis to process candidates' data and to use AI-assisted interviews in your hiring
  • Meeting the laws that apply to your hiring, including any rules on notice, consent, audits or record-keeping for AI-assisted or automated hiring tools, and data protection law. We provide a candidate notice and consent screen, but you remain responsible for your own obligations
  • Designing fair, job-related questions and rubrics, and not using the service to discriminate on any protected characteristic
  • Offering a reasonable alternative or accommodation when a candidate asks, including the human-interview requests we pass to you
  • Reviewing AI output with care, recording your decision and its reason, and keeping a human in charge of every decision
  • Responding to candidates' data requests we forward to you, and deleting data you no longer need
  • Only posting genuine jobs, and only inviting people who applied or agreed to be contacted

Using the Talent Network directory

Directory access is for companies hiring for their own team or, for agencies, for their clients. We may require a work email, review each request, and decline or withdraw access. If you use the directory, you agree to:

  • Request introductions only for genuine roles, and describe the role and salary range honestly
  • Use what you see, and the contact details and interview materials you receive after an introduction, only to recruit for that role, and not share them outside the people at your company (or your client) involved in that hiring
  • Not copy, export or scrape profiles, or contact a candidate outside an introduction they have accepted
  • Make your own hiring decision: a profile's interview results are evidence for a person to weigh, not a recommendation

6. Candidate responsibilities

  • Answer honestly and in your own words; do not let another person or tool answer for you
  • Share only the window or tab you are asked to share, and nothing confidential that belongs to someone else
  • Do not try to manipulate the AI interviewer (for example, by instructing it to score you highly)
  • In the InstaTalent Talent Network, keep one profile per person and keep it accurate. Duplicate accounts, and interviews taken by someone else, are removed

7. Acceptable use

You must not:

  • Use InstaTalent for anything unlawful, discriminatory, deceptive or harmful
  • Post fake jobs, collect candidates' data for unrelated purposes, or charge candidates to apply
  • Upload malware, scrape the service, probe or bypass its security, or overload it
  • Impersonate anyone, or access accounts or data that are not yours
  • Reverse-engineer the service or use it to build a competing product
  • Use the service to make solely automated decisions with legal or similarly significant effects on candidates

We may remove content or suspend accounts that break these rules.

8. Your content

You keep ownership of what you upload (jobs, CVs, messages, interview kits). You give us a licence to host, process and display it only as needed to run the service for you. You confirm you have the right to share it. InstaTalent, its software and its branding remain ours.

9. Plans, introductions and billing (employers)

  • The job board is free. Each plan includes a monthly number of introductions and, on paid plans, AI interviews for your own applicants. Current plans, allowances and prices are shown on our pricing page and in the product.
  • Introductions: an introduction counts only when the candidate accepts it. A request the candidate declines, or does not answer within the time shown, costs nothing. On paid plans, introductions beyond your monthly allowance are charged at your plan's rate for extra introductions. We charge no placement or hiring fees.
  • Subscriptions are billed monthly or yearly in advance through our payment provider and renew automatically until cancelled. You can cancel any time from your billing settings; cancellation takes effect at the end of the current billing period. Monthly allowances of introductions and interviews reset each month and do not roll over.
  • Interview packs are one-off purchases, used after your monthly allowance and valid for the period shown at purchase. Unused pack interviews expire at the end of that period.
  • Extras: on paid plans, introductions and interviews beyond your allowance (and any packs) are charged at your plan's rates, within the monthly spending limit you control, and added to your next invoice.
  • What counts: sending an invite reserves one interview; it is used when the candidate starts the interview. If you cancel the invite or it expires before the candidate starts, the interview is returned to your balance automatically.
  • Refunds: fees are non-refundable except as stated here or required by law. If an interview fails because of a fault on our side, contact billing@instatalent.dev and we will restore the credit.
  • Taxes: prices exclude VAT, sales tax and similar taxes, which are added where applicable.
  • Non-payment: if a payment fails, we may pause paid features such as extras, new invites and new introduction requests until it is resolved.
  • Price changes: we will give at least 30 days' notice of a price change, which applies from your next billing period.

10. Third-party services

We rely on trusted service providers to run the service (see our Sub-processors page). Optional features such as signing in with Google, and payments processed by our payment provider, are also subject to those providers' terms.

11. Availability and changes to the service

We work to keep InstaTalent available but do not promise uninterrupted service. We may change or discontinue features; if we discontinue a paid feature, we will give reasonable notice and refund prepaid, unused amounts for it.

12. Disclaimers

Except as stated in these terms, the service is provided "as is" and "as available". We do not guarantee that you will find a job or a candidate, that a candidate will accept an introduction or remain available, or that any job posting, profile or AI output is accurate. Nothing here limits rights you have under consumer protection law that cannot be excluded.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100. These limits do not apply to liability that cannot be limited by law, such as for fraud, gross negligence, or death or personal injury caused by negligence.

14. Indemnity

Employers will defend and indemnify us against third-party claims arising from their jobs, their hiring decisions, their use of AI interview output, or their breach of these terms or of applicable employment, anti-discrimination or data protection law.

15. Termination

You can stop using InstaTalent and delete your account at any time. We may suspend or end your access if you break these terms or the law, or if required to protect users or the service. On termination, paid subscriptions stop renewing, and we delete your data as described in the Privacy Policy and the DPA. Sections that by their nature should survive (such as payment obligations, liability limits and indemnity) survive termination.

16. Changes to these terms

We may update these terms. If a change is material, we will tell account holders by email or in the product at least 30 days before it takes effect. Continuing to use InstaTalent after that means you accept the new terms.

17. Governing law and disputes

These terms are governed by the laws of the State of Arizona, United States. Disputes will be resolved by the state and federal courts located in Maricopa County, Arizona, except that consumers may also bring claims in the courts where they live, and either party may seek urgent injunctive relief anywhere.
